Terms of service

These terms are between Zaah Holdings, Inc. (“we”), which makes the Daily Drops Shopify app, and the merchant who installs it (“you”). By installing or using the app you accept them. Shopify's own terms also apply to your store and to the app's charges.

1. The app

Daily Drops lets you run a calendar of daily offers on your Shopify store. You choose the offers and approve every day; approving creates the discount codes, gift discounts and, where an offer needs one, a hidden gift product in your store. You can change or delete what the app made at any time, and deleting a calendar removes the discounts and hidden products it created.

2. Your responsibilities

• The offers are yours. You decide what each day gives, and you honour the codes and gifts your calendar shows to customers.
• You make sure your promotions, and your store's privacy notice to your customers, comply with the laws that apply to your business.
• You keep your Shopify account and staff access secure.

3. Plans and charges

Building calendars is free. Publishing one needs a plan, charged monthly through Shopify's billing and shown on your Shopify invoice. You can change or cancel your plan at any time from the app's Plan page; cancelling stops your calendars being shown to customers. Plan prices and what each includes are listed in the app and on its App Store listing.

4. Data processing

This section is our data-processing agreement with you. For your customers' information, you are the controller and we are your processor.

• What we process, and why. Only what is needed to run your calendar and report on it: the information listed in our privacy policy — your calendars and settings; for orders placed with a calendar's codes, the order number, code and total (no customer name, email, address or phone); access-code recipients you add; and, only where the shopper allows analytics, a visitor cookie and a count of visits.
• Your instructions. We process this information only to provide the app to you, as you configure it. We do not sell it, use it to advertise, or combine it with other stores' data.
• Consent. The storefront respects your customers' choices in Shopify's cookie-consent settings: without analytics consent, nothing is counted and no visitor cookie is set.
• Who else handles it. Shopify, which hosts your store; Google Cloud, where the app and its database run, in the United States; and OpenAI, only for drafting a calendar's wording when you ask, which never receives customer information. We will tell you before adding another service that handles your customers' information.
• Security. Data is sent over HTTPS and encrypted at rest; access to the database is limited to the people who run the app, who are bound to keep it confidential.
• Incidents. If we become aware of unauthorised access to your data, we will tell you without undue delay and help you meet any duty you have to report it.
• Requests and deletion. When a customer asks your store for their data or to be erased, Shopify tells the app and we provide or delete what we hold on them. 48 hours after you uninstall the app, Shopify tells us and we delete everything we hold for your store.
• Transfers. Data is stored in the United States. Where the law requires safeguards for that transfer, the safeguards in Shopify's terms and our providers' terms apply.

5. Availability and changes

We work to keep the app running and accurate, but it is provided “as is”, without warranties beyond those the law requires. We may change or improve the app; if a change removes something you rely on, we will tell you in the app first. If these terms change, the date at the top changes and significant changes are shown in the app.

6. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for lost profits or sales, and our total liability for any claim is limited to the fees you paid for the app in the three months before it arose. Nothing here limits liability that cannot be limited by law.

7. Ending

You can stop using the app at any time by uninstalling it. We may suspend it for a store that uses it unlawfully or to harm others. Section 4's deletion terms apply when it ends.
